Kennebunk, Maine Accessory Dwelling Unit (ADU) Rules

City Acceptance Rating: 6/10

The following standards must be met in order to create and maintain an accessory apartment:

  1. No more than one accessory apartment is permitted per single family lot.

  2. Either the primary or converted unit may be occupied by the owner of the property as its primary physical residence (primary residence shall be defined as more than 6 months per year).

  3. Both the primary and the accessory unit must be occupied as primary residences.

  4. A permit for an accessory apartment must be issued to the owner of the property. This permit does not run with the land, and is automatically invalidated by the sale or transfer of the property.

  5. Only one (1) unit on the property may be rented; and other must be occupied by the owner.
